1. Acceptance of Terms

State Highway Dept provides professional paving and road construction services, including but not limited to:

All services are subject to availability and our acceptance of your project request.

4. Service Agreements

Estimates and Quotes

All estimates and quotes provided are based on the information available at the time and are subject to change based on actual site conditions, material costs, and project scope modifications.

Contract Formation

A binding contract is formed only when both parties sign a written service agreement. Estimates and quotes do not constitute binding contracts.

Payment Terms

Payment terms will be specified in individual service agreements. Generally:

  • Payment schedules are based on project milestones
  • Final payment is due upon project completion
  • Late payments may incur additional charges
  • We accept cash, checks, and major credit cards

5. Project Execution

Site Access

Client must provide safe and reasonable access to the work site. Any delays caused by access issues may result in additional charges.

Weather Conditions

Paving work is weather-dependent. Projects may be delayed due to adverse weather conditions without penalty to State Highway Dept.

Permits and Approvals

Unless otherwise specified in the service agreement, obtaining necessary permits and approvals is the client's responsibility.

Change Orders

Any changes to the original scope of work must be agreed upon in writing and may result in additional charges.

6. Warranties and Disclaimers

Service Warranty

We warrant our workmanship for a period specified in individual service agreements, typically one year from project completion. This warranty covers defects in workmanship but does not cover:

  • Normal wear and tear
  • Damage from improper use or maintenance
  • Damage from extreme weather events
  • Settling or movement of underlying surfaces

Disclaimer

Except as expressly stated in service agreements, our services are provided "as is" without warranties of any kind, either express or implied.

7. Limitation of Liability

To the maximum extent permitted by law, State Highway Dept's total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

8. Indemnification

Client agrees to indemnify and hold harmless State Highway Dept from any claims, damages, or expenses arising from:

  • Client's breach of these Terms or service agreements
  • Client's negligent or wrongful acts
  • Third-party claims related to the project site
  • Failure to obtain necessary permits or approvals

9. Insurance

State Highway Dept maintains appropriate insurance coverage, including:

  • General liability insurance
  • Workers' compensation insurance
  • Commercial vehicle insurance
  • Professional liability insurance

Proof of insurance can be provided upon request.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of State Highway Dept and is protected by copyright and other intellectual property laws. You may not use our content without written permission.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

12. Termination

Jurisdiction

Any disputes arising from these Terms or our services shall be resolved in the courts of Kansas.

Mediation

Before pursuing legal action, parties agree to attempt resolution through mediation with a mutually agreed-upon mediator.

14. Force Majeure

State Highway Dept shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, labor disputes, or material shortages.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
